Do I need a will if my estate is modest?
A will is useful regardless of the size of your estate. Without one, the distribution of your assets is determined by the statutory rules on intestacy under Thai law, which may not reflect your own preferences. A straightforward will can be prepared in a single appointment series and provides clarity for your family when the time comes.
How long does will preparation take?
The process typically involves two appointments. At the first, we discuss your circumstances and wishes; the draft is then prepared and sent to you for review. At the second appointment, we go through the document together, make any adjustments, and proceed to signing. For most clients, both appointments can be completed within two to three weeks.
I have property in another country. Does that affect my Thai will?
It may. The laws governing the inheritance of immovable property generally follow the rules of the country in which that property is situated. For clients with assets in more than one jurisdiction, we often recommend preparing separate documentation for each country, coordinated so they work together without conflict. Our cross-border estate service is designed for exactly these situations.
What is the difference between a will and an estate plan?
A will sets out how your estate is to be distributed after your passing. An estate plan is broader — it may include a will, but also addresses arrangements made during your lifetime: gifts, joint ownership, considerations around the timing of transfers, and ongoing family conversations. For clients with more complex circumstances or longer-term concerns, an estate plan provides a more complete framework.
Can I update my will later if my circumstances change?
Yes. A will can be amended or entirely replaced at any time, provided you retain the capacity to do so. Life events such as marriage, the birth of a child, or a significant change in your financial situation are common reasons clients return to review their arrangements. We recommend a periodic review every few years or following any major change in circumstances.
Is the information I share with you kept confidential?
All information shared in the course of our engagement is held in strict confidence under the principles of solicitor-client privilege. We do not share client information with third parties except where required to carry out the work — for example, with co-counsel in another jurisdiction when handling a cross-border matter — and only with your knowledge.
